‘Western countries are more corrupt than African countries’ – Human rights lawyer. Femi Falana

Human rights lawyer and Senior Advocate of Nigeria (SAN) Femi Falana, has said that “Western countries are more corrupt than African countries”.

Falana noted that “There has been a massive and accelerated transfer of much of the wealth from the developing world into developed economies around the world, much of which was looted from various treasuries across Africa and in the rest of the developing world”.

He stated this today in a paper titled Human Rights Issues Surrounding The Non-Return Of Assets To Countries Of Origin and delivered last week at the Second Forum of the Anti-Corruption Situation Room, organised by the Human and Environmental Development Agenda (HEDA).

“African governments and anti-corruption bodies should stop labelling Africa as a continent of corrupt people. London is the centre of global corruption. The banks of western countries receive and keep stolen wealth from Africa and other developing countries. Western governments conveniently hid behind the free movement of capital ideology to fold their arms and turn the other way for many years after the end of the Cold War. This laissez-faire attitude on the part Western leaders encouraged corrupt leaders from Africa to use stolen wealth from their various countries to establish an individual presence in their economies; buying shares in major corporations, mansions and other landed properties, yachts, planes, you name it.

Mr David Cameron whose family name was listed in the Panama papers had the temerity to label Nigeria as a fantastically corrupt country. The Abacha loot of about $5 billion has been traced to banks in Switzerland, United Kingdom, United States and other western countries. Apart from Switzerland which has reluctantly returned part of the loot no other recipient country has recovered and repatriated a dime to Nigeria. Since the Joseph Kabila regime has failed to request for the repatriation of the over $10 billion kept in Zurich banks by the late Mobutu Sese Seko, the Swiss government is planning to return the looted wealth to the family of the former dictator and not to the people of the Democratic Republic of the Congo.

Throughout the 1970s and much of the 1980s, money leaving Africa into Europe and other parts of the world took an upward trajectory, leaving essential services to rot and decay. What then followed was a serious economic crisis across Africa, which witnessed the International Monetary Fund (IMF) setting up offices inside the various ministries of finance in state after state on the continent, as it tried to help implement a harsh austerity programme to “re-adjust” the various economies. Nigeria has lost billions to illicit financial outflow resulting from corruption and embezzlement of funds by public officials. Nigeria’s history as a “fantastically corrupt” country is apparent upon an appraisal of the activities of its past leaders and public officials especially as it relates to the conversion of government fund.

Meanwhile, scores of African “migrants” were finding their ways into Europe, looking for employment and a better life. This alarmed Western governments whose citizens began to make their feelings known by voting in right-wing governments promising to put a stop to immigration from so-called “Third World” countries. The idea of untrammelled, free movement of capital economic orthodoxy has long been dead and buried. Western Governments, especially the USA, now freely impose sanctions against countries, for instance, Iran and Russia, even against specific individuals and companies in those countries and elsewhere in the world. Why then have corrupt political leaders in Africa and their stolen wealth not attracted the same level of vigour and scrutiny? It is simply that corrupt money emanating from Africa and elsewhere had long been thought of as a ‘victimless’ crime.

There is, after all, no one visibly hurt, no building being blown up, no planes flying into high rise buildings or anything of that nature. It was seen as just another typical “Third World” malaise. Well, not any more. There is a nexus between stolen wealth and human rights. It is the intersection between poverty and international (human rights) principles. Stolen wealth is not an abstract idea dangling in the air; it fosters poverty, diseases and illiteracy, ill-health and general social deprivations. It also subverts good governance and the rule of law of the country from which the wealth has been stolen. Every single one of the index of underdevelopment mentioned above is interwoven with the holding of stolen wealth and it is inimical to basic human rights and decency. I fully concur with Dr Kolawole Olaniyan who has said that grand corruption breeds bad governance, instability, and creates opportunities for criminal entrepreneurs to thrive, as politicians and their friends tend to take advantage of weak law enforcement and gaps within the criminal justice systems to use public offices for private gain. But unless the people are made the centre of development there will always be enough funds to steal and transfer abroad or keep locally by unpatriotic public officers. Multinational corporations and politically exposed persons from western countries enjoy almost absolute immunity in many African states. While Africans are prosecuted for engaging in corrupt practices their foreign accomplices who are treated like sacred cows due to political pressure from their home governments.

Notwithstanding that the Buhari administration has demonstrated some political will to fight corruption it has not been able to order an investigation into serious allegations of corruption involving multinational corporations and other western companies. For instance, the petition to the government alleging theft of crude oil worth over $200 billion by indicted oil and shipping companies has been ignored. Even instead of directing the EFCC to recover the huge fund, the federal government has continued to take multi-billion-dollar loans from China and African Development Bank. Whereas the officials of Halliburton involved in bribing Nigerian government officials with $180 million to secure a contract were prosecuted by the United States government the EFCC was pressurised to drop the charges against, Mr Dick Chiney, a former Vice President who was the managing director of the company at the material time. No doubt, recovery and return of stolen assets stashed in Western economies and transparent and accountable management and use of returned funds would help strengthen the ability of victim countries to fortify the rule of law, improve access to justice (and consequently, enjoyment of human rights) and reduce state impunity. It will also serve as a measure of accountability, with huge potential to reduce impunity thereby impacting on respect for human rights including socio-economic rights in African countries. Since public officers are prohibited from keeping and maintaining foreign accounts, civil actions should be filed against public officers whose foreign accounts have been identified and located.

Anti-graft agencies should speed up the trial of politically exposed persons whose assets have been traced to foreign countries. Once the cases are concluded and forfeiture orders are made by trial courts the judgements should be registered abroad and enforced. The governments of victim countries should institute civil proceedings in countries where the nation’s stolen wealth has been located. The EFCC in Nigeria has secured some orders of Mareva injunctions against the assets of some Nigerian citizens and companies which are said to proceed with economic and financial crimes. Foreign banks that have aided public officers to launder stolen money should be reported to the relevant financial regulatory and anti-corruption bodies. Western governments should be requested to impose the visa ban on public officers who have engaged in corruption and money laundering.

Reports of investigation of the allegations of such practices should be made available to the embassies. For the credibility of the request, the reports should include the names of serving public officers who have been indicted. Western countries should deny visas to any public officer travelling for medical treatment abroad. African countries should lead a campaign for the classification of grand corruption as a crime against humanity which should be tried by the International Criminal Court. Loopholes in the financial system should be blocked to prevent capital flight and money laundering. Banks and other financial institutions aiding money laundering should be sanctioned and made to pay aggravated and exemplary reparation. They may also be sued in the countries where the offences may have been committed.”

Why you’ll not catch Meghan Markle on dark nail polish or fake talons

Why you

Meghan Markle has had to adjust her lifestyle to fit into the royal family since her famous engagement and wedding. Apart from no selfies, no more social media, no getting involved in politics, she had to say goodbye to dark nail polish as it is against the royal rules.

According to Metro.com, Uunatural nails and dark polish is considered ‘vulgar’ by the Queen, so at all public appearances for the royal family, only natural-looking nails are permitted, which means no dark polish, no massive fake talons, and no trendy nail art.

Prince Harry and Meghan Markle release official royal wedding photos taken by Mario Testino

The official wedding photos of Prince Harry and Meghan Markle have been released today and they are extraordinary, to say the least.

The three photographs shared by Kensington Palace are being referred to as the boldest and most intimate royal portraits ever released.

Accompanying the photos was a message from Harry and Meghan saying they “feel so lucky” to have shared their big day with the world. They also thanked their millions of adoring fans for their messages.

A Kensington Palace spokesperson said: “The Duke and Duchess of Sussex would like to thank everyone who took part in the celebrations of their wedding on Saturday. They feel so lucky to have been able to share their day with all those gathered in Windsor and also all those who watched the wedding on television across the UK, Commonwealth, and around the world.

“Their Royal Highnesses are delighted with these official portraits taken by Alexi Lubomirski and are happy to be able to share them today. They would also like to say thank you for all of the generous messages of support they have received.”

Of the three photos shared, the most striking image is of Meghan sitting between Harry’s legs as the prince looks smiling at the camera while his new bride laughs at someone off camera.

Another wedding photo features The Queen, Prince Phillip, Prince Charles, Camilla Parker Bowles, Prince William, Kate Middleton, Prince Harry, Meghan Markle and all the bridesmaid and page boys. The photo has an informal feel and shows Prince George and Princess Charlotte grinning widely.

The couple were captured by Alexi Lubomirski, 42, the protege of photographer Mario Testino who was famously beloved by Harry’s mother Princess Diana. He was also the one who took Harry and Meghan’s official engagement photos.

Mr Lubomirski, 42, whose own wife looks very much like Meghan, called Meghan’s relationship with Prince Harry a “wonderful love story”.

Meghan and Harry’s choice of official images can be seen as the next stage of their royal revolution.

”I regret supporting Saraki’s emergence as Senate President” Senator Ali Ndume says

Senator Ali Ndume who represents Borno south senatorial district, was one of the APC senators that went against the party’s decision to facilitate the emergence of Senator Bukola Saraki as the senate president in 2015.

In an interview with Channels TV, Ndume who was suspended by the Saraki-led senate for calling for an investigation into the alleged involvement of the senate president and Senator Dino Melaye in corrupt practices, says he regrets supporting the senate president.

When asked by the interviewer, Maupe Ogun Yusuf, if he regrets supporting Saraki, Ndume said:

”Yes, I do.  Look at the senate now, we have been reduced to unbearable level of integrity, just because of few people, few person, that is wrong. I don’t want to be individualistic about it. We put the leadership there for Saraki; if you want me to be specific about it, and then it turns out to be another thing. We have senator’s president now, instead of senate president.

“I speak the truth a lot even if I’m alone, and I stand by it. We started with the issue of Magu, I was with you on national TV and that is history now, then we came out and the second issue was that of the car importation, and the issue of Dino Melaye’s certificate and then I was shockingly suspended for 180 days  and it was not the committee that recommended that. My colleagues did not not know about the report that was used to suspend me illegally and unconstitutionally for 180 days. That’s why I went quietly to court and you see the response of my people then.

“It is not fair for one among equal to take himself up, and use, take advantage of the gavel to rule instead of to lead, instead of to preside, that is what the constitution says. The senate president is to preside, he doesn’t even have a vote, he has no voice. By the time you accept being the senate president, you have lost your right to some extent as a senator until the senate ties, that is when you come in to break the ties. This is not the case, as senate president will say, ‘I direct so so so and my member.  I mean, it’s very unfortunate, I personally did not expect this. That is how we got it wrong, because once an individual thinks he owns the senate, and he dishes out the direction, and dishes out what he thinks, you’ll always get it wrong… 108 heads are better than one. But for now, senate at certain point is like Dino and Saraki. It is very unfortunate.”

Dino Melaye shares photo from his hospital bed, thanks Nigerians for standing by himThe embattled senator who was granted bail last week, shared the open letter to Nigerians on his Facebook page this afternoon. Read below

Someone once said, that, rock bottom is good solid ground and a dead-end street is just a place to turn around. In the last few weeks, I have been taken to the good solid ground at the rock bottom and they couldn’t go further. I have been brought to the dead-end street but with you standing by my side, I have turned around and bounced back to the chagrin of those who sought to seal my lips from speaking out against tyranny, politics of oppression and blackmail. They, unleashed an endless barrage of physical, psychological, metaphysical and emotional torture and assault on me, but, through the power of the Most High, and you the good people of Nigeria, we have once again, seen the triumph of truth over lies and good over evil.

It was Edmund Burke who was quoted as saying that when bad men combine, the good must associate; else they will fall one by one, … in a contemptible struggle. I am of all men, a blessed man, to have courageous and dependable people like you as my fellow soldiers in the struggle to free us from the shackles of political strongholds and tyranny. It is to you and my most wonderful and ever knowledgeable people of Kogi State, especially Kogi West, that I owe my deepest gratitude. You stood by me against the state and your own ‘best political self-interest’.

The state unleashed its raw power on me and released a 200 man-strong fully armed policemen – on a man without a knife nor a bullet. It did this because I called injustice by its name and called for accountability. For this they sought to break my spirit and destroy me permanently. In their moment of reign, I was fully shackled. With my hands tied to my back, and hurled into a dark solitary confinement waiting for the butchers knife, you, my people stood by me. You came against a raging fire and stood up against tyranny, lies, filthy lucre, injustice, persecution and greed. While in the dark and unable to fight for myself, they sought to take my mandate, which you had freely given to me. But you answered back and quenched deceit in its wake. You stood resolute and unflinching and defended your mandate to me. I thank you from the bottom of my heart. In their attempt to break me, they have made me stronger.

To you my indefatigable leaders; my irremovable President of the Senate, a man of immeasurable vision for Nigeria and true fighter for the enthronement of true democracy and the rule of law, Sen. (Dr.) Abubakar Bukola Saraki. The fearless Speaker of the House of Representatives, Rt. Hon. Yakubu Dogara, I thank you both for your steadfastness in the defence of the Nigerian Constitution and the enthronement of the Rule of Law, justice and equity and the emasculation of anti-democratic forces and tyranny everywhere in Nigeria. I am eternally grateful to you.

To the entire National Assembly Membership, especially my colleagues in the Senate, I am eternally indebted to you for not playing politics but standing courageously against oppression and terror. You have shown yourself leaders on whom Nigeria’s hope for tomorrow can be assured.
6. To you our governors, ministers, my dear Okun people and leaders, the National Chairman and Kogi State Executive of the PDP, leaders of the Diplomatic Corps, opinion leaders, Chief Mike Ozekhome SAN, Chief Ricky Tarfa SAN, human rights lawyers and activists, and all my well-wishers and lovers of democracy in Nigeria; the Christian and Muslim Community, all of you that visited me in the National Hospital, after I was injured and subsequently detained at the hospital. I thank you all for your steadfastness in the defence of due process and the rule of law. I also thank you for your courage and solidarity.

Our ever foresighted and courageous civil society leadership, the media, leaders of thought across the country, our hard-working youth for whom I will give my last blood, our loving mothers and sisters, I lack words to express to you my profound gratitude for the unbreakable chord of love that binds me to you through thick and thin. You have strengthened my resolve and hardened my flesh against those who seek to devour and make meat of me. You have once again proven to me the axiom in the saying that “in prosperity, our friends know us; in adversity, we know our friends.” I am very grateful. For your sake, I remain unbowed.

I know many of you worry about my safety and life in this new dispensation where life is no longer sacred in Nigeria. But do not be troubled. My bond of love for you, my good people, makes it impossible for me to consider my self-risk, safety, comfort or opportunity in my unflinching commitment to stand up for you, to stand up for truth and if necessary die for the truth and the emancipation of our people from the chains of poverty and oppression. Though they raise spurious allegations against me, bear false witness against me, though they seek to frighten me and lure me into their bounty of evil, I will fear no foe.

Yes, my traducers and torturers wish that I keep quiet; though they seek to seal my lips, to silence my voice forever, I remain ever more resolute and committed. I am committed to this cause for which I am a politician; the cause of the down trodden, to speak truth to power and stand against oppression and injustice. On these issues there will be no compromise. I owe no apologies and I tender none.

Like I have always said, you speak the truth, you die, you don’t speak the truth, you die. I have chosen to speak the truth, dead or alive. Rev. Martin Luther King Jnr., once said, “Cowardice asks the question – is it safe? Expediency asks the question – is it politics? Vanity asks the question – is it popular? But conscience asks the question – is it right? And there comes a time when one must take a position that is neither safe, nor politic, nor popular; but one must take it because it is right.”

To my people, I promise you this and this only. I have taken my position, I will not hold back, I will not hold my peace, I will not be shut down, neither will I shut-up, not as long as injustice and falsehood continues to reign, as long as I will live, I will not bow to Baal.

May the Almighty continue to keep you all and be your bulwark until victory is assured. Once again, I thank you all so much.

God bless you.
God bless the Federal Republic of Nigeria.

Super cop, Abba Kyari’s squad arrest ‘most-wanted’ Offa armed robbery suspects

Super cop, Abba Kyari

Two more suspects have been arrested in the deadly armed robbery attack in Offa, Kwara State, last month. This comes three weeks after the police circulated pictures of four suspects who were captured by closed-circuit camera of the banks that they attacked.

At least five banks were raided during the April 5 incident. Seventeen people, including nine police officers, were confirmed killed by the police. The suspects taken into custody are: Kunle Ogunleye (a.k.a.: Arrow), a native of Kwara State, and Micheal Adikwu, a native of Apa Local Government Area, Benue State.  Ogunleye, 35, was arrested on Sunday in Oro, Kwara State.

One of the suspect, Adikwu was reportedly dismissed as a police corporal following his arrest in 2012 on alleged criminal offences. He was charged to court in Kwara State for compromising police operations and releasing armed robbery suspects. He reportedly escaped from prison in 2015 and joined armed robbery gangs.

It was not immediately clear whether he was found guilty and convicted by the court or whether he escaped from prison while still in remand as his trial was underway. He was arrested by the police intelligence response team (IRT) led by CSP. Abba Kyari in Kwara State two weeks ago, about a week after the police declared him wanted and circulated his picture to the public.

“All suspects arrested among others have confessed” their roles in the Offa carnage. They are assisting the IRT teams in arresting more of the bank robbers as the police continue the investigation” PRNigeria said.

Gina Haspel sworn in as CIA’s first female director

Gina Haspel sworn in as CIA

Gina Haspel, 61, is being sworn in as the CIA’s first female director.

The ceremony took place on Monday morning, May 21, at agency headquarters in Langley, Virginia, with President Donald Trump in attendance.

Gina Haspel will be the first female director in the 71-year history of the agency. The 61-year-old, who has been a CIA employee for 33 years, won Senate confirmation last week after overcoming concerns about her role in the agency’s use of harsh interrogation techniques after 9/11.

Her nomination was controversial due to her history at the CIA, including her oversight of a secret “black site” in Thailand in 2002 where suspected terrorists were tortured, and she wrote a 2005 order, at her supervisor’s request, to destroy 92 videotapes that showed CIA agents waterboarding prisoners.

Haspel was backed by many in the CIA rank and file and senior intelligence officials, including former CIA directors and national intelligence directors. Opponents argued it was wrong to reward someone who supervised a covert detention site in Thailand where terror suspects were harshly interrogated.

But  Haspel promised senators at her confirmation hearing that she would not restart the torture program if confirmed as CIA director, even if pressed to do so by President Trump. Trump has said in the past that “torture works” and that he would consider using it again.

Haspel will replace Mike Pompeo, who left the CIA late last month to become Trump’s new secretary of State.
