Appeal Court stays execution of judgment sacking Oshiomhole as APC National Chairman

The Appeal Court which made a U-turn and heard an appeal filed by Adams Oshiomhole over his suspension as Chairman of the All Progressives Congress (APC) today March 16, has stayed the execution of the judgement issued by the Federal High Court in Abuja on March 4, 2020.

 

The three-man panel led by Justice Abubakar Datti Yahaha, which granted reliefs contained in an ex-parte motion argued by the lead lawyer to Oshiomhole and the APC, Wole Olanipekun (SAN), temporarily stopped the respondents from carrying out by the judgement issued by the federal high court pending the determination of a motion on notice filed by Oshiomhole and the APC.

 

In his argument in the ex-parte application which has APC’s National Vice Chairman (Northeast) Mustapha Saliu, Edo State APC Chairman, Anselm Ojezua, Alhaji Sani Gomna, Mr Oshawo Stephen, Mr. Fani Wabulari, Mr. Princewill Ejogharado, the Inspector General of Police and the State Security Service as respondents, Olanipekun stated that the federal high court judgement has created confusion in the party.

 

Olanipekun said;

 

“There is move to hold a National Executive Council meeting without the appellant. If the NEC is allowed to hold without the appellant, there will be no return to the status quo ante bellum.

“There can not be two pilots in an aircraft at the same time.”

 

Justice Yahaya who read the lead ruling, asked the Oshiomhole and the respondents to settle their differences amicably.

 

He said;

 

“We have considered the application and have looked closely at the affidavit in support and the exhibits.

“We are of the view that an emergency picture has been painted, so that an intervention by this court at this time, and in this process, is warranted.

“There is the information that a National Executive Council (NEC) meeting of the second applicant (APC) is to be held tomorrow. and, following the ruling of the FHC High Court under consideration, the 1st applicant (Oshiomhole) will not be able to attend.

“If this happens, then there is no assurance that any status quo ante bellum would be maintained.

“The status quo can only be maintained. in this circumstances if there is a stay of the execution of the ruling of the FCT High Court.

“In this vein therefore, we find merit in the application. We hereby order a stay of execution of the ruling of the FHC High Court in suit No: FCT/FC/CV/17/2020 delivered on the 4(h of March 2020 pending the determination of the motion on notice.

“As a coronary, we also hereby, givean order of injunction, restraining the respondents themselves, their agents, privies and officers, jointly and severally from proceeding to take any other steps to give effect to the said ruling, pending the determination of the motion on notice.

“Since the appellants have transmitted records and have filed a brief, they have demonstrated interest in prosecuting the appeal. The appeal is given accelerated hearing”

“Having said all these, we implore political parties to try to resolve their deferences. amicably without the necessity. of involving the court at all times.”

The European Union has revealed plans to ban all non-essential travel from all outsiders for a month after Europe emerged as the center for “coronavirus epicentre.”

 

Ursula von der Leyen, the president of the European Commission proposed a ban on foreign travel into all of the EU, meaning all travel would be restricted into the 26-nation Schengen free travel area for 30 days.

The 26 Schengen countries are: Austria, Belgium, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, and Switzerland.

 

Ms von der Leyen told a press conference: ‘The UK citizens are European citizens so of course there are no restrictions for the UK citizens to travel to the continent.’

 

She added: ‘Here in Europe we are heavily affected by coronavirus and we know that everything that reduces social interaction also reduces the speed of the spread of the virus.

 

‘The less travel, the more we can contain the virus.

 

‘Therefore, as I have just informed our G7 partners, I propose to the heads of state and governments, to introduce temporary restrictions on non-essential travel to the European Union.’

 

She said exemptions would include long-term EU residents, family members of EU nationals, diplomats, doctors and researchers working on containing the health crisis.

 

Doctors, nurses, care workers, and experts tackling the coronavirus pandemic would also be exempt, Ms von der Leyen said.

 

Globally, more than 174,000 people have contracted the deadly coronavirus around the world – and 6,000 people have died from the virus.

A young football coach, Francisco García has died from coronavirus, after doctors also diagnosed him with leukaemia.

 

The 21-year-old who was the youth team coach at Malaga-based club Atletico Portada Alta, had an unknown pre-existing health condition that resulted in him being more vulnerable to the virus than usual for an individual of his age, though he was only informed of having cancer after going to the hospital with symptoms of coronavirus, according to Spanish newspaper Malaga Hoy.

 

While he was struggling to breathe, he was advised to seek further medical help which he did and was told that he had both coronavirus and pneumonia. Doctors later disclosed to him that he had leukaemia, which increased the level of risk that he was exposed to after contracting the virus.

 

A club statement read: “We want to express our deepest condolences to the family, friends and close friends of our coach Francisco Garcia who has left us, unfortunately.

 

“Now what do we do without you, Francis? How are we going to continue conquering … in the league? We don’t know how, but we will surely do it for you.

 

“We will not forget you, rest in peace, phenomenon. Until forever.”

 

Club president, Pep Bueno also paid tribute to him.

 

Bueno said: “Francisco was a great guy and a very talented coach. We are all still shocked.

 

“The hospital rang me at 7pm on Sunday to say his condition had stabilised, but then an hour later because of the coronavirus and (cancer) … I do not believe it. It seems impossible to me.”

Idris Elba tests positive for coronavirus

British actor, Idris Elba has announced that he tested positive for coronavirus despite not showing any symptom.

 

In an announcement made in a video shared on Twitter on Monday March 16, the actor said he underwent medical tests after realizing he was exposed to someone who had also tested positive. Idris revealed that he self-quarantined after finding out about the undisclosed person’s test result.

 

He wrote;

 

“This morning I tested positive for COVID-19. I feel OK, I have no symptoms so far but have been isolated since I found out about my possible exposure to the virus. Stay home people and be pragmatic. I will keep you updated on how I’m doing. No panic.

“It sucks. Looks, this is serious. Now’s the time to really think about social distancing, washing your hands.”

The suit is as regards the song “Gbese” by Dj Tunez and Wizkid which was said to have infringed on the copyright of the hit song “Fe Fe Ne Fe” by Tic Tac and Tony Tetuila without authorisation from Tony Tetuilla and Tic Tac.

As at the time of this report Wizkid’s camp hasn’t responded to the charges raised against them and the case is now lodged at the Federal High Court in Ikoyi.

A Nigerian lawyer, Victor Nkemjika, has taken to Twitter to mourn a couple who died in the explosion that rocked the Abule Ado axis of Lagos state on Sunday March 15th.

 

According to friends of the couple, the deceased husband was an only son while the deceased lady was an only daughter of her parents. It was also revealed that the deceased lady was a first class accounting graduate.

A couple and their three children have been reported to be among the 17 persons confirmed dead in the explosion that took place at the Abule Ado axis of Lagos state in the early hours of Sunday March 15th.

 

According to reports, the couple and their children were caught in the fire caused by the explosion while driving in their vehicle to church.

 

The Director General/CEO LASEMA, Dr. Olufemi Oke-Osanyimtolu, who confirmed the number of casualties, said the cause of the explosion is yet to be ascertained.

“17 bodies have been recovered while 25 casualties are being treated for injuries on site. We sympathise with the families that lost their loved ones to the inferno and wish the injured quick recovery. We appeal for calm and urge residents to shun fake news. Operation is still in progress. Updates will continue through the course of operation while investigations remain on going” stated Oke-Osanyintolu.

 

Over 50 buildings in the area and neighbouring communities were affected by the unfortunate incident.

Gas cylinders hit by a truck caused explosion in Abule Ado – NNPC

The management of the Nigerian National Petroleum Corporation (NNPC) has revealed that the explosion which rocked Abule Ado community of Lagos State earlier today, was caused by a truck which struck gas cylinders in the community.

 

In a statement released by NNPC, it was gathered that the gas cylinders which was hit by the truck were stacked in a gas processing plant located near the corporation’s system 2B Pipeline Right of Way.

 

The corporation explained that preliminary findings indicated that the impact of the explosion was so huge that it led to the collapse of nearby houses and damage to NNPC pipeline on which efforts are being made to curtail the resultant fire.

 

The Group Managing Director of NNPC, Mallam Mele Kyari and other top Management of the corporation departed for Lagos this evening for an on-the-spot assessment at the scene of the incident.

The Nigerian National Petroleum Corporation (NNPC) Sunday said that the reported explosion which rocked Abule Ado Area of Lagos State in the early hours of the day was as a result of gas explosion which occurred after a truck hit some gas cylinders stacked in a gas processing plant located near the corporation’s system 2B Pipeline Right of Way.

In a press release signed by NNPC Group General Manager, Group Public Affairs Division, Dr. Kennie Obateru, the corporation explained that preliminary findings indicated that the impact of the explosion was so huge that it led to the collapse of nearby houses and damage to NNPC pipeline on which efforts are being made to curtail the resultant fire.

The Group Managing Director of NNPC, Mallam Mele Kyari and other top Management of the corporation departed to Lagos this evening for an on-the-spot assessment at the scene of the incident.

Obateru stated that following the report of the explosion, the corporation quickly halted ongoing pumping operations on the Atlas Cove-Mosimi pipeline which was active at the time.

The release explained that NNPC had already mobilized its in-house combined team consisting of Health Safety Environment experts, Medical and Security personnel from its nearby Satellite Depot in Lagos, even as Lagos State Fire Service was also rallied to extinguish the fire.

The release said more fire firefighting personnel and equipment were mobillised from the NNPC Mosimi Area Office to provide extra fillip to the ongoing operation.

While assuring members of the public and residents of the affected communities to remain calm, the NNPC’s spokesman assured that the temporary shutdown of the petroleum products pipeline would not affect the normal supply of products to the Lagos and its environs.

He said the fire, currently burring at controlled condition, was being fought headlong, saying a detail assessment of the incident was underway to establish the extent of damage to the pipeline.

The NNPC Group Managing Director, Mallam Mele Kyari, commiserated with the victims of the incident, praying that God provides them succor at this hour.

The United States government has claimed that there is sufficient evidence to support allegation of operatives of the Nigerian army and Department of State Services intimidating voters, electoral officials and election observers during 2019 general election.

 

In its 2019 country reports on human rights practices, the US Department of State insisted that the 2019 election which did not encourage enough voter participation was marred by violence and other irregularities, particularly in the Southern part of the country.

 

The report partly read;

 

“There was evidence military and security services intimidated voters, electoral officials, and election observers. In addition violence in several states contributed to lower voter participation and added to the sentiment the army is a tool of the ruling party in many parts of the country, particularly in the South.

“For example, widespread violence and military involvement in electoral processes, including during the vote collation process, significantly scarred the governorship election in Rivers State. Additionally several of INEC’s resident electoral commissioners (RECs) reported DSS operatives intimidated them when the RECs attempted to protect voting materials.

“Some RECs reported security service personnel visited them multiple times prior to the elections. Press reported certain RECs claimed the DSS was surveilling the RECs and that they had been brought to DSS offices for questioning.”

 

The 46-page report which further claimed that vote-buying were historically high during the 2018-19 electoral season especially in Kano and Osun State, stated that the Nigerian judiciary is still susceptible to intimidation by the executive and the legislative arms of government.

 

It further stated that the corruption in the judiciary backed with the poor pay judicial officers get, has hindered the third arm of government from functioning independently. The US Department of State also averred that judges are easily bribed in Nigeria and litigants cannot rely on the courts to render impartial judgments.

 

It added;

 

“Although the constitution and law provide for an independent judiciary, the judicial branch remained susceptible to pressure from the executive and legislative branches. Political leaders influenced the judiciary, particularly at the state and local levels.

“Understaffing, underfunding, inefficiency, and corruption prevented the judiciary from functioning adequately. There are no continuing education requirements for attorneys, and police officers were often assigned to serve as prosecutors. Judges frequently failed to appear for trials. In addition, the salaries of court officials were low, and they often lacked proper equipment and training.

“Although the Ministry of Justice implemented strict requirements for education and length of service for judges at the federal and state levels, no requirements or monitoring bodies existed for judges at the local level. This contributed to corruption and the miscarriage of justice in local courts.”
